Though the Supreme Court of India was inaugurated on 28th January 1950, the rules and procedures as applicable to the Federal Court were continued for a long time thereafter.
Article 145(1) of the Constitution of India empowers the Supreme Court to frame Rules. In the spirit thereof, in May 1964, the then Chief Justice of India – Hon’ble Justice Gajendragadkar, constituted a committee of 3 (three) Members of the Supreme Court Bar, namely Shri Narayan Andley, Shri I.N. Shroff, and Shri Janardan Sharma, and further directed the Registrar and the Deputy Registrar to assist the said committee, which was then bestowed the monumental task of drafting the Revised Rules and to submit them for the consideration of the Hon’ble Chief Justice.
It was after that, that the Hon’ble Chief Justice constituted a sub-committee comprising of 5(Five) Hon’ble Judges viz, Mr. Justice Subba Rao, Mr. Justice Wanchoo, Mr. Justice Hidyatullah, Mr. Justice J.C. Shah and Mr. Justice Sikri, to examine the draft Rules and to consider any further suggestions from the members of the bar.
Thereafter, the full Court finalized the Rules, which later received the sanction of the President of India on 20th December 1965. Under these Rules, the concept of Advocates on Record came to be formalized.
